Rules for posting and appealing claims and reviews on com-stil.com

  • These rules have been developed by the administration of com-stil.com on the basis of generally accepted rules for dispute resolution in business. Since com-stil.com is an international site, when claims are heard in the courts of specific countries, the requirements of legislation may differ from those indicated.
  • On com-stil.com, the term "Claim" means an appeal by one user of the site to another regarding violations of contractual obligations in their economic interaction and a demand for monetary compensation for these violations.
  • On com-stil.com, a claim may only take the form of monetary demands. If you have requirements of a different nature, you should convert them into monetary form.
  • On com-stil.com, the parties to a dispute are called the Creditor and the Debtor; both must be registered and be users of com-stil.com. A Creditor is a natural or legal person who has submitted a claim; a Debtor is a natural or legal person to whom demands are made.
  • Claims submitted on com-stil.com must necessarily contain the following information:
    • A description of the circumstances that led to the dispute, justification and calculation of the required amounts.
    • Copies of documents that confirm that contractual obligations existed between the creditor and the debtor and that these obligations were not fulfilled or were fulfilled improperly. Copies are provided in electronic form.
    • The creditor's requirements: the exact amount of the claim, the deadline and method of its payment.
  • The purpose of publishing a claim on com-stil.com is to inform the public about violations committed by one of the users registered on the site against another, and the creditor's financial demands.
  • Before being posted on com-stil.com, claims go through moderation. First, the site's lawyers review the validity of the claim, and only after that is it posted on the site.
  • If a document is already posted on com-stil.com, the decision to delete a claim can only be made by the site administration.
  • These rules are mandatory for citizens and organizations that have chosen this method of dispute resolution.
  • The creditor is responsible for the information contained in the claim. Review of the claim by com-stil.com lawyers does not mean that the site accepts any responsibility. We check the general grounds, but we are unable to verify the authenticity of evidence or conduct other examinations.
  • When pre-moderating a claim by com-stil.com lawyers, the following is examined:
    • The presence or absence of the fact of providing or not providing a service that is the basis for the claim. Verification is conducted based on the documents provided.
    • Compliance of the applicant with one of the parties to the dispute. A com-stil.com user does not have the right to submit a claim on behalf of other persons.
    • Compliance of the provided documents with generally accepted rules of record-keeping.
    • Compliance of the claim's format with generally accepted rules and the rules of com-stil.com.
  • Com-stil.com does not accept for consideration:
    • Any electronic correspondence, except for documents certified by electronic digital signature.
    • Screenshots of any electronic devices.
    • Photo and video documents.
    • Documents concerning payments that do not bear a bank stamp.
    • Documents that are difficult to read and understand due to damage for any reason.
    • Electronic documents in formats that allow their editing.
  • In the process of reviewing and posting claims, com-stil.com has the right to:
    • Require elimination of violations of these rules.
    • Request proof of the case. If documents are not provided, the claim will not be posted on com-stil.com.
    • Request clarification from the creditor.
    • Refuse to post a claim when the circumstances of its submission or the evidence raise doubts.
    • Remove posted reviews and claims if new circumstances come to light.
  • A decision to refuse to post a claim may be made on the following grounds:
    • The creditor's withdrawal of the claim.
    • Violation of these rules, provided that the deficiencies are not remedied within 1 day from the moment of such a request from com-stil.com.
    • Failure to provide the requested additional documents within 1 day from the moment of such a request from com-stil.com.
    • The presence in the text of the claim of threats, insults, materials promoting hatred on any grounds, profanity. Profanity is determined by the moderator; references to the fact that individual characters in words have been replaced with others are not accepted.
    • Doubts by the administration of com-stil.com about the authenticity of the stated circumstances or the authenticity of the documents provided.
    • In other cases, in accordance with these rules or legislation.
  • A claim already posted on com-stil.com may be deleted in cases:
    • A request for this from the creditor.
    • Satisfaction of a complaint filed by the debtor.
  • Claims recognized or paid by debtors are not removed from com-stil.com. However, the status of the document changes.
  • Debtors have the right to appeal claims made against them. The right of appeal is provided once. Re-appeal is only possible if new circumstances come to light.
  • When appealing a claim, the statement includes:
    • A description of the conflict with the creditor from the debtor's point of view, and the grounds for not recognizing the demands.
    • Copies of documents confirming the debtor's innocence, in electronic form, in formats that do not allow their editing.
  • Complaints on com-stil.com are considered within 5 days or more.
  • In the process of reviewing complaints, com-stil.com may:
    • Require elimination of deficiencies and non-compliance with these rules.
    • Request the provision of relevant documents from both the debtor and the creditor. Failure to provide documents may result in rejection of the complaint or removal of the claim.
    • Request any clarification of the case from both the debtor and the creditor.
    • Refuse to grant the complaint or decide to remove the claim if doubts arise about the authenticity of the circumstances of the case or the authenticity of the documents.
    • Remove a claim or review based on these rules or the requirements of legislation.
  • The conclusions of com-stil.com employees regarding claims and complaints are not evidence for the court and have no legal force.
  • If the debtor has financial claims against the creditor, he has the right to post on com-stil.com a counterclaim. It will be accepted if it relates to the same relationship between the debtor and the creditor as described in the previously submitted claim.
  • Com-stil.com has the right to make changes and amend these rules without notifying or warning site users. We recommend regularly checking them for changes.
  • Submission of a claim or a complaint against it confirms that the authors are familiar with these rules and fully accept them.
